What is consumer bankruptcy and who may declare it?
Consumer bankruptcy is a court procedure that allows a natural person not conducting business activity to free themselves from obligations they cannot meet. It is available to any consumer who has become insolvent, that is, has permanently lost the ability to pay due debts.
Since 24 March 2020, simplified rules have been in force - as a rule, the court no longer examines whose fault caused the insolvency at the stage of the bankruptcy declaration itself. These circumstances do, however, affect the length of the repayment plan. This solution is aimed, among others, at people who lost their jobs, became ill, fell into a spiral of loans, or guaranteed someone else's debt.
How do the proceedings unfold step by step?
We conduct the proceedings in three transparent stages, so that you know what to expect at every step:
- Stage I - free analysis: within approximately 24 hours we assess your situation and the chances of declaring bankruptcy, free of any charge.
- Stage II - preparation of the petition: we prepare a complete petition to the court together with a list of assets and creditors, cost from 900 zł net.
- Stage III - conducting the proceedings: we represent you before the court and the trustee, cost from 500 zł net payable only after bankruptcy is declared.
After bankruptcy has been declared, the estate is managed by a trustee, and the court establishes the creditors' repayment plan.
How long does the repayment plan last and how does bankruptcy end?
The creditors' repayment plan is usually set for a period of up to 36 months. However, if you brought about your insolvency intentionally or through gross negligence, the court may establish a longer plan - from 36 to 84 months.
The purpose and most common outcome of the proceedings is the discharge of debts - after completing the repayment plan (and in exceptional situations even without one), the remaining debts are discharged. In this way you regain a real chance for a fresh financial start, free from bailiff seizures.
