How to pursue payment from an unreliable contractor?
Pursuing payment usually begins with a demand for payment, followed by a statement of claim filed with the court having jurisdiction over the value and type of the case. In payment cases it is often possible to use order-for-payment or writ-of-payment proceedings, in which the court issues an order for payment at a closed session, thereby shortening the path to an enforcement title.
We analyse the documentation, assess the chances and prepare the statement of claim together with the requests for evidence. After obtaining a final and binding judgment, we help to have an enforceability clause granted and to refer the case for enforcement by a court bailiff.
What does a defence against a civil claim look like?
Defence against a claim is based on a thorough analysis of the merits of the demand and a timely procedural response. Of key importance is the response to the statement of claim and the raising of the appropriate objections, including the objection of limitation, which the court as a rule takes into account only at the request of a party.
We establish the facts, gather evidence and build a litigation strategy tailored to the case. We represent clients at hearings and in appellate proceedings before the regional and appellate courts.
How much does conducting a civil case cost?
The cost depends on the value of the subject matter of the dispute, the complexity of the case, and the scope of the activities, and we set the fee individually. Added to the costs is the court fee on the statement of claim, which as a rule amounts to 5% of the value of the subject matter of the dispute, as well as any costs of expert opinions. The first preliminary case analysis is free of charge.
