How do we assist in issuing administrative decisions and applying the KPA?

We advise authorities on issuing administrative decisions in compliance with the Code of Administrative Procedure (KPA). We help conduct proceedings correctly - from initiation and the gathering of evidence, through ensuring the parties' active participation, to the proper justification and service of the decision.

We review draft decisions for compliance with substantive and procedural law, which reduces the risk of a decision being overturned on appeal. We also assist administrative authorities in Gdańsk and Gdynia in appeal proceedings and in matters concerning the declaration of invalidity and the reopening of proceedings.

How do we help in public procurement matters?

We support contracting authorities at every stage of public procurement proceedings. We advise on the preparation of documentation, including the terms of reference, and on the evaluation of tenders and the selection of the contractor in accordance with the Public Procurement Law.

We represent entities in appeal proceedings before the National Appeals Chamber (KIO) and advise on the performance and amendment of public procurement contracts. We help institutions from the Tri-City conduct proceedings in a way that limits the risk of breaching public finance discipline.

Under the Code of Administrative Procedure, an appeal against a decision is, as a rule, filed within 14 days from the date of its service. The appeal is addressed to the higher-level authority through the authority that issued the decision. We help entities properly handle the appeal proceedings and prepare the authority's position.
How much time is there to make public information available?
Public information is made available without undue delay, no later than within 14 days of the date the request is filed. The deadline may be extended to a maximum of 2 months, provided the applicant is informed of the reasons for the delay. We advise on how to properly handle requests and avoid an allegation of inaction.
Do you serve public bodies on an ongoing cooperation basis?
Yes, we offer public administration units ongoing legal services in the form of a subscription. It provides day-to-day advice, the review of resolutions and decisions, and representation in proceedings. This model gives the institution a predictable cost and constant access to a lawyer.
